Market Data Notice and Subscriber Self-Certification
Last updated October 15, 2026
This notice explains where the market data in Kassia comes from, who owns it, what you may do with it, and the statements you make about yourself to receive it. It is from GY Capital Group LLC ("GY Capital", "we", "us"), which operates Kassia.
1. Where the data comes from
Kassia shows prices, quotes, volumes and other information about indexes, options and futures, and analytics derived from them ("Market Data"). Market Data is created by the exchanges and index providers that own it, including Cboe (for SPX and VIX), the options exchanges whose quotes are published through the Options Price Reporting Authority (OPRA) and, for futures, CME Group. It reaches Kassia through licensed data vendors and brokers (together with the exchanges, "Data Providers").
2. Real-time and delayed data
- Desk and Desk Pro show Market Data in real time.
- Basic, the free trial and the Private Preview show it at least 15 minutes behind the market. Each delayed panel is labelled with its delay.
- The cost to close a position you hold, and data from your own brokerage account, may be shown on a different schedule; where it is delayed, it is labelled.
3. Who owns the data, and whose terms apply
- Market Data belongs to the Data Providers. GY Capital does not own it and cannot give you any right in it beyond the limited use described here.
- The terms that each Data Provider sets for people who receive its data apply to you, through Kassia, and the Data Providers may enforce them directly. Where a Data Provider requires you to accept its own subscriber agreement, we will show it to you, and you must accept it to receive that data.
- If a Data Provider tells us to stop giving you its data, we will stop, and this does not entitle you to a refund except as our Refund & Cancellation Policy provides.
4. How you may use Market Data
- Only for your own personal, non-business investing.
- Do not copy, sell, publish, share, retransmit or otherwise redistribute it, including in screenshots posted publicly or in group chats, and do not let anyone else use your account to see it.
- Do not extract it automatically, by scraping, scripts or similar means, except through tools Kassia provides for that purpose on your plan.
- Do not use it to build a database, index or product, or to calculate prices for others.
5. Non-professional subscriber: what it means
Kassia is offered only to non-professional subscribers. You are a non-professional subscriber only if all of the following are true:
- you are an individual using Market Data only for your own personal investing, and not for any business, company, partnership, trust or other organization;
- you are not registered or qualified in any capacity with the SEC, the CFTC, any state securities agency, any securities exchange or association, or any commodities or futures contract market or association;
- you are not engaged as an investment adviser, whether or not you are registered as one;
- you are not employed by a bank, insurance company or other organization that is exempt from securities registration to do work that would require registration if done elsewhere; and
- you do not share, show or redistribute Market Data to anyone else, and do not use it for anyone else's benefit.
Anyone else is a professional subscriber.
6. Your self-certification
By answering the market-data questions in your account application and signing it, you certify that your answers are true, that you are a non-professional subscriber as described above, and that you will use Market Data only as section 4 allows. You agree to tell us within 10 days at info@gycapital.net if that changes. If it changes, or we learn it was not true, we may end your access to Market Data or close your account, and you may owe any professional fees a Data Provider charges for the period you were a professional subscriber.
7. Records and reporting
Data Providers may require us to report how many subscribers receive their data and of what kind, to keep records of your certification, and to let them audit those records. You agree that we may do so.
8. No warranty
Market Data can be delayed, interrupted, incomplete or wrong. Neither GY Capital nor any Data Provider guarantees its accuracy, timeliness or completeness, and none of them is liable for any loss caused by relying on it, to the extent the law allows. Our Terms of Service describe the limits on our liability.
